Terms and Conditions
- Services Provided: The Agency offers recruitment, staffing, and human resources consulting services. This includes candidate sourcing, selection, screening, and placement based on the Client’s specific requirements. The Agency may also provide consulting services related to HR policies, training, and organizational development.
- Candidate Placement: The Agency strives to provide Clients with qualified candidates matching their requirements. However, the final decision to hire a candidate rests solely with the Client. The Agency does not guarantee the suitability, performance, or actions of any candidate placed.
- Fees and Payments: Clients agree to pay the Agency for its services as outlined in a separate agreement or as per mutually agreed-upon terms. Fees may include placement fees, recruitment charges, or hourly rates for temporary staffing. Payment terms and methods will be specified in the agreement.
- Confidentiality: The Agency acknowledges that it may have access to confidential information during the recruitment process. The Agency agrees to handle such information with the utmost confidentiality and not disclose it to any third party without the explicit consent of the Client.
- Non-Solicitation: Clients agree not to directly solicit or offer employment to any candidate introduced by the Agency during the term of engagement and for a specified period afterward, as outlined in the agreement.
- Compliance with Laws: The Agency and Clients agree to comply with all applicable local, state, and federal laws and regulations related to employment, including but not limited to equal opportunity laws, non-discrimination laws, and immigration laws.
- Liability and Indemnification: The Agency shall not be liable for any damages, losses, or claims arising out of the use of its services. Clients agree to indemnify and hold the Agency harmless from any claims, liabilities, or expenses arising from their actions or omissions, including but not limited to claims related to the employment or termination of candidates introduced by the Agency.
- Termination: Either party may terminate the engagement by providing written notice to the other party. Termination does not relieve the Client of any outstanding payment obligations.
- Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
- Entire Agreement: This Agreement constitutes the entire understanding between the Agency and the Clients and supersedes any prior agreements, whether written or oral, relating to the subject matter herein.
- By engaging the services of the Agency, Clients acknowledge that they have read, understood, and agreed to abide by these Terms and Conditions.
